Event Waiver

Participant understands and acknowledges that participating in Pink Pistols of Denver events, including but not limited to shooting classes, involves inherently dangerous activities. Risks include, but are not limited to, serious bodily injury, permanent disability, hearing loss, eye injury, lead exposure, property damage, and death. These risks may result from the Participant's own actions, the actions of others, or the failure or misuse of equipment. To the extent the subject event includes travel to a venue, risks may also include the risk of a motor vehicle crash and the risk of all injuries that could arise from such an incident. Participant further acknowledges and understands that the foregoing is not an exclusive list of all risks possibly associated with Pink Pistols of Denver events and Participant agrees that the above listed risks in no way limit the scope of this release and covenant not to sue. By signing this Agreement, the Participant voluntarily and knowingly assumes all risks, both known and unknown, associated with the class and/or travel to and/or from the class.

Participant, on behalf of themselves and their heirs, executors, and assigns, hereby releases, waives, and forever discharges Pink Pistols, Pink Pistols of Denver, their officers, instructors, members, volunteers, and affiliates (collectively, the "Released Parties") from any and all risks, liability, claims, or causes of action arising out of or related to any loss, damage, or injury, including but not limited to injury, paralysis, or death, that may be sustained by the Participant, whether caused by the negligence of the Released Parties or otherwise, while participating in the shooting class, traveling to and/or from the class, or while on the premises where the class is conducted.

Participant acknowledges that this Agreement is made in order to allow them to participate in Pink Pistols Events. Participant further acknowledges and agrees that Pink Pistols of Denver is offering them services at no or a reduced cost and at no profit to Pink Pistols of Denver. Participant agrees that Pink Pistols of Denver, for itself and all Released Parties, has provided consideration for this Agreement.

Participant understands that Released Parties are not liable for any legal or financial responsibility for any lost or stolen personal property. Participant assumes the risk of bringing money, jewelry, firearms, valuables, or other personal property to Pink Pistols of Denver events.

Participant acknowledges that Pink Pistols of Denver officers, members, and/or instructors may remove Participant from a Pink Pistols of Denver event at any time and for any reason. Reasons for exclusion include, without limitation, impairment, Participant's failure to follow one or more rules of firearms safety, harassing behavior by Participant, abusive language used by Participant, and/or failure to appear for a safety briefing. Participant acknowledges that they are not entitled to a refund of any amounts paid in the event they are removed from an event.

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and reasonable attorney fees, that the Released Parties may incur due to Participant's presence at or participation in the class, whether caused by the negligence of Released Parties or otherwise.

Participant authorizes the Released Parties to seek or provide emergency medical treatment if necessary and agrees to be solely responsible for all costs associated with such treatment and transportation.

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado. If any portion of this Agreement is held to be invalid or unenforceable, the remaining terms shall continue in full legal force and effect.

This Agreement shall apply to all Pink Pistols events that Participant attends and shall continue in perpetuity unless modified by a subsequent agreement. Any such agreement must be in writing in a form prepared by Pink Pistols of Denver. The Agreement may not be unilaterally altered by Participant, nor may the Agreement be modified orally.

In the event of any dispute between the Released Parties and Participant relating to this Agreement, such disputes shall first be submitted to mediation with the mediator of the Released Parties' choice. In the event any such dispute cannot be resolved by mediation, any suit must be filed in the county in which the incident giving rise to the dispute occurs. Participant waives any right to a jury trial in any suit against or involving the Released Parties relating to this Agreement, and such disputes shall instead be tried to a judge.

In the event of any suit against Released Parties that is determined not to be barred by this Agreement, Participant agrees that any and all liability of the Released Parties shall be limited to recovery from any applicable policies of insurance.
